Terms of Service
1. Agreement
By accessing or using Gravify at gravify.co (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Gravify is a web-based software-as-a-service (SaaS) tool that enables users to create 2D physics animation videos for short-form content platforms. The Service is operated by Tom Pohlandt, Osterlund 3, 24944 Flensburg, Germany ("we", "us", "our").
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service.
4. Subscriptions and Payment
The Service offers a free tier and paid Pro subscriptions (monthly at €9.99/month or yearly at €79/year). Payments are processed by Paddle.com Market Limited, who acts as Merchant of Record. All prices are inclusive of applicable VAT where required by law.
- Subscriptions renew automatically unless cancelled before the next billing date.
- You can cancel your subscription at any time through your account settings or by contacting us at hello@gravify.co.
- Cancellation takes effect at the end of the current billing period; you retain access until then.
- For consumers in the EU/EEA: you have a right of withdrawal within 14 days of purchase, unless you have already used the service (e.g. downloaded an export), in which case the right of withdrawal is lost. See our Refund Policy for details.
5. Acceptable Use
You agree not to:
- Use the Service to create content that is illegal, harmful, defamatory, or infringes third-party rights.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Use automated tools to scrape, crawl, or overload the Service.
- Resell or sublicense access to the Service without our written consent.
- Upload audio or assets for which you do not hold the necessary rights.
6. Intellectual Property
The Service and its underlying technology remain the property of Tom Pohlandt. Videos you export using the Service are owned by you. Free-tier exports may carry a watermark; removing the watermark without a Pro subscription is not permitted. Pro subscribers receive a commercial license to use their exported videos.
7. Availability and Changes
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue features at any time. We will provide reasonable notice of material changes to paid subscribers.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free or that exports will meet platform-specific technical requirements.
9. Limitation of Liability
To the fullest extent permitted by applicable law, our total liability to you for any claims arising from the use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
10. Governing Law
These Terms are governed by the laws of Germany. For consumers in the EU, mandatory consumer protection provisions of your country of residence apply.
11. Dispute Resolution
We prefer to resolve disputes informally. Please contact us first at hello@gravify.co. The EU Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution procedures.
